Please read these Terms and Conditions carefully before using Webpulse (webpulse.co.ke). By accessing or using the platform, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account or using Webpulse, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree, do not use the platform.
2. Description of Service
Webpulse is an online job listing platform that allows employers to post job vacancies and job seekers to browse, search, and apply for those vacancies. Webpulse does not act as an employer, recruitment agency, or intermediary in the hiring process unless explicitly stated.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for providing accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify Webpulse immediately of any unauthorized use of your account.
- Each person may only maintain one account. Duplicate accounts may be suspended.
- Webpulse reserves the right to suspend or terminate accounts that violate these terms.
4. For Job Seekers
- You confirm that all information in your profile, CV, and applications is truthful and accurate.
- You may not use automated tools, bots, or scripts to mass-apply for jobs.
- You may not misrepresent your qualifications, experience, or identity.
- You understand that Webpulse does not guarantee employment or a response from employers.
- You are solely responsible for evaluating any job opportunity, employer, or interview invitation.
5. For Employers
- You confirm that you are authorized to post job listings on behalf of your organization.
- All job listings must be for genuine, available positions. Fake, misleading, or fraudulent listings are strictly prohibited.
- Job listings must not discriminate on the basis of race, gender, religion, disability, age, or any other protected characteristic under Kenyan law.
- You must comply with all applicable employment laws in Kenya, including labor laws, tax obligations, and workplace safety regulations.
- You are responsible for your own hiring decisions. Webpulse does not endorse, vet, or guarantee any candidate.
- Paid listings and promoted features are subject to separate agreements and the advertised pricing at the time of purchase.
6. Prohibited Conduct
Users may not:
- Post fake, fraudulent, or misleading job listings
- Collect fees from job seekers in exchange for job placements, interviews, or application processing unless explicitly disclosed and legally permitted
- Use the platform to harass, threaten, or discriminate against any person
- Scrape, crawl, or extract data from the platform without written permission
- Post content that is illegal, defamatory, obscene, or infringes on third-party rights
- Impersonate another person or organization
- Interfere with the technical operation of the platform
- Create multiple accounts for the purpose of manipulation or abuse
7. Content
- Users retain ownership of the content they post (CVs, job descriptions, company profiles).
- By posting content, you grant Webpulse a non-exclusive, worldwide license to display, store, and distribute that content for the purpose of operating the platform.
- Webpulse reserves the right to remove any content that violates these terms or is otherwise objectionable, without prior notice.
8. Fees and Payments
- Basic job seeker features are free. Webpulse may introduce premium features for job seekers in the future with clear disclosure.
- Employer services (job postings, promoted listings, candidate access) are subject to fees as displayed on the platform at the time of purchase.
- All prices are quoted in Kenyan Shillings (KES) unless otherwise stated.
- Payment must be made through the methods provided on the platform. Webpulse reserves the right to change available payment methods at any time.
- No refunds will be issued for job postings once published, unless the listing was removed due to an error on our part.
9. Intellectual Property
All content on Webpulse that is not user-submitted—including but not limited to the platform design, logo, code, graphics, and text—is the property of Webpulse and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without prior written permission.
10. Limitation of Liability
- Webpulse provides the platform on an “as is” and “as available” basis without warranties of any kind, express or implied.
- Webpulse does not guarantee the accuracy, completeness, or reliability of any job listing, candidate profile, or user-submitted content.
- Webpulse is not liable for any loss, damage, or expense arising from the use of the platform, including but not limited to loss of employment opportunities, hiring decisions, or interactions between users.
- Webpulse’s total liability shall not exceed the amount paid by you to Webpulse in the twelve months preceding the claim.
- Webpulse is not responsible for the actions, policies, or conduct of any employer or job seeker using the platform.
11. Indemnification
You agree to indemnify and hold harmless Webpulse, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
12. Termination
- You may deactivate your account at any time by contacting support@webpulse.co.ke.
- Webpulse may suspend or terminate your account at its sole discretion if you violate these terms, engage in prohibited conduct, or for any other reason with or without notice.
- Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.
13. Modifications to Terms
Webpulse reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
14. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be resolved in the courts of Kenya, with Nairobi as the jurisdiction of choice.
